Criminal law and criminal case law describe:
- which actions are punishable (This is how criminal law determines the actions one can be punished for.);
- under which conditions the State has the jurisdiction to punish a person or a body for breaking the law;
- in what ways the State can punish a person or a body for nonobservance of the law.
Criminal law distinguishes between offences and crimes. An offence is a minor infringement of the law. Driving without security papers is an example of an offence. A crime is a more serious violation of the law. Theft and murder are examples of crimes.
Criminal law is laid down in the Codes of Criminal Law of Aruba and the Netherlands Antilles.
